Terms of Service (TOS)

These Terms of Service (“Terms”) govern your access to and use of the services provided by The Strategist Analyst (“we,” “our,” or “us”), operating under KD Digital Hub in Naivasha, Kenya. By accessing or using our services, you agree to these Terms in full.

1. Services

The Strategist Analyst provides digital systems, infrastructure, performance marketing, AI solutions, cybersecurity, trading intelligence, and related consulting services. Services may be delivered via:

  • Digital platforms and websites

  • Onsite installations or physical support

  • Reports, audits, or consultations

We reserve the right to update, modify, or discontinue any service at any time with prior notice.

2. Client Obligations

Clients agree to:

  • Provide accurate, complete, and current information during engagement

  • Maintain the security of login credentials and access points

  • Comply with applicable local laws and regulations

  • Refrain from using services for illegal or unauthorized purposes

Failure to meet these obligations may result in suspension or termination of services.

3. Payment Terms

  • Service fees will be clearly communicated in proposals or contracts.

  • Invoices are payable according to agreed terms. Late payments may incur interest or service suspension.

  • Free trials or promotional periods (e.g., first month hosting free) are limited to one per client and subject to cancellation if terms are violated.

4. Intellectual Property

  • All software, tools, systems, and content provided by The Strategist Analyst remain our intellectual property.

  • Clients are granted a limited, non-exclusive license to use services strictly for their internal business operations.

  • Unauthorized reproduction, resale, or distribution of our IP is prohibited.

5. Privacy & Data Protection

We collect, store, and process personal and business data according to our Privacy Policy, available on our website. By using our services, clients consent to this collection and processing.

6. Limitation of Liability

To the maximum extent permitted by law:

  • The Strategist Analyst is not liable for indirect, incidental, or consequential damages arising from use of services.

  • We do not guarantee specific financial outcomes, ROI, or market results.

  • Clients remain responsible for their business decisions and operational risks.

7. Termination

  • Either party may terminate services with written notice.

  • We reserve the right to terminate services immediately for breach of Terms or illegal activity.

  • Upon termination, client data may be returned or securely deleted, as agreed.

8. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall be resolved under Kenyan jurisdiction.

9. Changes to Terms

We may revise these Terms at any time. Updated versions will be posted online with an updated “Effective Date.” Continued use of services after changes constitutes acceptance.
